Donkeys Adventures Private Limited Company, a registered company under Government of Nepal, Ministry of Industry, Office of the Company Registrar with registration no: 180752/074/075, located at Nursery Street Lazimpat - 2 Kathmandu Nepal will be selling its package trips, products and services on its online platform where user need to get registered as “Partner” or “Guest”. Please read the details of our Terms & Conditions before any booking procedure is made. After clicking - I agree DA Terms and Conditions – in your holiday cart, a legally binding contract is therefore made.
The following agreement is made in relationship between you (hereinafter referred as the “Client” or “Guest” or “Partner”) and Donkeys Adventures Pvt. Ltd. (hereinafter referred as “Donkeys” or “DA” or “The Company”) register under Company Act of Nepal. By clicking – I agree DA Terms and Conditions, both parties are bound by the Terms and Conditions regarding all kinds of booking, cancellation policies, obligations, limitations of liability, Purchase of DA holiday Packages and all others which details are mentioned below. Both parties agree to these Terms and Conditions to resolve any legal or other disputes that may arise in the completion of trip. If you do not agree to this contract (“Contract” or “User Agreement”), do not click “I agree DA Terms and Conditions” and do not access or otherwise use any of our Services. If you wish to terminate this contract, at any time you can do so by closing your account and no longer accessing or using our Services.
Here are some promises that you make to us in this Contract:
2.1.1 You’re eligible to enter into this Contract and you are at least our “Minimum Age.” The Services are not for use by anyone under the age of 16.
2.1.2 To use the Services, you agree that: (1) you must be the “Minimum Age” or older; (2) you will only have one Donkeys account which must be in your real name. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 16.
2.1.3 “Minimum Age” means 16 years old. However, if law requires that you must be older in order for Donkeys to lawfully provide the Services to you without parental consent (including using of your personal data) then the Minimum Age is such older age.
2.1.4 When you accept this booking/reservation terms and conditions you (and any other person on whose behalf you book/ reserve) agree to accept all these conditions, you acknowledge that you have read the conditions of this agreement and you warrant that the information given by you on the website www.donkeysnepal.com and booking/reservation form is complete and accurate.
2.2.1 You will keep your password a secret.
2.2.2 You will not share an account with anyone else and will follow our rules and the law.
2.2.3 “Partners” and “Guests” are account holders. You agree to: (1) try to choose a strong and secure password; (2) keep your password secure and confidential; (3) not transfer any part of your account (e.g., connections). You are responsible for anything that happens through your account unless you close it or report misuse.
2.2.4 As between you and others (including your employer), your account belongs to you. However, if the Services were purchased by another party for you to use (e.g. Recruiter seat bought by your employer), the party paying for such Service has the right to control access to and get reports on your use of such paid Service; however, they do not have rights to your personal account.
2.3.1 We may change, suspend or end any Service, or change and modify prices prospectively in our discretion. To the extent allowed under law, these changes may be effective upon notice provided to you.
2.4.1 Donkeys reserves all of its intellectual property rights in the Services.
2.4.2 Using the Services does not give you any ownership in our Services or the content or information made available through our Services.
2.4.3 Trademarks and logos used in connection with the Services are the trademarks of their respective owners.
2.4.4 Donkeys Adventures, and “Donkeys” logos and other Donkeys Adventures trademarks, service marks, graphics, and logos used for our Services are trademarks or registered trademarks of Donkeys Adventures Pvt. Ltd.
This is our disclaimer of legal liability for the quality, safety, or reliability of our Services.TO THE EXTENT ALLOWED UNDER LAW, DONKEYS AND ITS AFFILIATES (AND THOSE THAT DONKEYS WORKS WITH TO PROVIDE THE SERVICES) (A) DISCLAIM ALL IMPLIED WARRANTIES AND REPRESENTATIONS (E.G. This website is for your personal and commercial use; in accordance with the terms and conditions of this agreement, and as a condition of your use you warrant and represent to DONKEYS ADVENTURES PVT. LTD. that you will not use this website for any illegal purpose or for any purpose that is prohibited by the terms and conditions of this agreement. Specifically, you may not modify copy, distribute, transmit, publish, display, license, create derivative works from or sell any product, develop, support or use software, devices, scripts, robots, or any other means or processes (including crawlers, browser plugins and add-ons, or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services, information or software obtained from this website.
4.1.1 A package and trips refers to any DA’s services, activities or product itinerary that are listed in our site or that are tailored made and sent through DA official emails which than is bought by client from us such as Tours, Trekking, Expeditions, flights tickets, transportation, guides services and any other adventures programs.
4.1.2 Once the booking is made, the processed booking will be listed in “Pending Trips” of your account, which will then be verified for the advance payment and then the booking conformation invoice is send through DA official mail. At this point the booked trips will be listed in your “Confirmed Trips” and the contract between the company and the client comes into existence. Before this point the company reserves the right to change in the price.
4.1.3 Please note that the company would not be liable to any warranty, collateral agreement, prior agreement, description of services, or conditions, other than as expressed herein.
4.2.1 For all trips and packages bookings, Clients need to deposit or pay 30% advance of the total price on the time of booking unless other conditions applies. Remaining 70% of the total price is to be paid on arrival day or before the departure day in some conditions like added products and services.
4.2.2 If you're booking 30 days or less prior to departure, full payment is to be paid in advance.
4.2.3 The advance deposit must be sent to the Company or its Agents which details are in Payment section.
4.2.4 Any international flight sales will be made only after full payment is made in advance.
We are not liable of any delay or loss during the advance payment process, if in case due to use of mediator bank or any other reasons, if the money received by us is less than the amount sent, you are requested upon arrival to pay accordingly so that the total is equivalent to the package cost booked.

DA accept manual offline bank card payment with Visa, MasterCard, American Express or UnionPay and so, the client need to download the manual offline bank card payment form, fill all the details with the advance deposit amount, card holder signature as in Passport, scan it and send the form along with the passport copy and credit card both side copy. 3.5% card service charge is applied on the total advance deposit amount. The bank card holder should be one of the travelers himself or herself. The same card should be used during final payment on arrival day in Nepal.
Clients can send the advance payment to an individual person authorized by the company through remittance like Money gram, Western union and other remittance easily excess to you. Please communicate with the company before choosing the Remittance company.
Final payment of your booking must be made on arrival or before arrival day in Nepal.
4.4.1 Final payment can be made by bank transfer on arrival or before arrival date.
4.4.2 Almost all kind of cash is acceptable and can be mode of final payment as per the transaction day exchange rates
4.4.3 Bank card like Visa, MasterCard, American Express or UnionPay is accepted to make final payment on arrival day. These bank card must be of the client himself or herself. There is 3.5% of total transaction as bank card charge taken my banks when the payment is made by any bank cards.
4.4.4 If the advance payment is made through manual offline bank card payment than the final payment must be made with the same bank card. If any other card is used than we will charge you 100% payment first and then return the 30% of your advance.
Any cancellation by a Client must be made in writing and acknowledged by the Company. The date on which the request to cancel is received by the Company or its Agents will determine the cancellation charge applicable. The cancellation charges are expressed hereafter as a percentage of the total booking price:
4.5.1 Cancellation 60 days or more before trip start date: 100 % of the advance paid is refundable and refund transfer fee applied is to be paid by client.
4.5.2 Cancellation 59-30 days before trip start date: 50% of the advance paid is refundable and refund transfer fee applied is to be paid by client.
4.5.3 Cancellation less than 30 days before trip start date: no refund is made for the booking advance paid to the company by client.
4.5.4 No refunds will be made if the client voluntarily leave a trip for any reason after the trip has begun. No refunds will be made for any accommodation, transportation, sightseeing, guide services, meals or any services not utilized.
4.5.5 Cancellation or amendment in itinerary of the tour or trek by clients due to Altitude sickness or any other illness will be result in the new itinerary and the new expenses is to be covered by the clients themselves.
4.5.6 Date change of the trip or package can be made 30 days before trip start date with mutual communication and additional cost might apply in some conditions which are subjected to availability.
4.5.7 There will be no discounts or refund for missed or unused services, this includes voluntary or involuntary termination/departure from tour, i.e. sickness, death of a family member etc, late arrival on the tour, or premature departure either voluntarily or involuntarily.
4.6.1 Donkeys Adventures reserves the right to cancel any trip, including a guaranteed trip, prior to departure due to reasons beyond its control (i.e. due to natural disasters, flight cancellation, consequences of strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather conditions, or other untoward occurrences. In such case Donkeys Adventures will refund the price after deducting the cost that has already been spent for the preparation of your trips or cancellation charges from outsource like Airlines, transportation companies, hotels etc.
4.6.2 If Donkeys Adventures cancels a guaranteed booked trips, client can either choose the refund or you are entitled to take an alternative trip of the same value. Please also note that significant alterations do not include a change of airline carrier, flight time tables or itineraries provided the departure and arrival dates remain unchanged, the substitution of a vessel, modification of itineraries, and change in cabin category or hotel accommodation provided it is of the same category.
4.6.3 Donkeys Adventures is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the booking cancellation from the company such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.
4.6.4 If Donkeys Adventures cancellation is due to ‘force majeure’ any reasonable expenses, we have incurred will be deducted from your refund. (War, civil or political unrest is usually known as force majeure). All refunds and compensation are strictly limited to moneys paid to us and we are not liable for any expenses you have incurred as a result of this booking. Your holiday will not be cancelled after the final payment is due unless we are forced to do so by force majeure.
4.6.5 Should Donkeys Adventures deem it advisable to amend an itinerary for any reason, it may do so by shortening, varying or re-routing any trip. These changes are binding and additional expenses will be charged to you if the reason for any alteration is outside Donkeys Adventures Control.
5.1.1 The Company must be notified in writing at the time of booking of any medical conditions, physically challenged conditions or any other mental and or physical condition which may affect fitness to travel and or any medical condition.
5.1.2 Failure to notify the Company may result in the client being refused to travel and can results in cancellation will result in 100% cancellation fees to the Client.
5.1.3 Some trips may be unsuitable for Clients due to age, mobility, pregnancy or physical or mental conditions. It is the Client’s responsibility to check prior to booking.
5.1.4 The Company is not required to provide any special facilities unless it has agreed to do so in writing. The Company will do its best to meet Clients special requests including dietary, but such requests do not form part of the Contract and therefore the Company is not liable for not providing these requests. Medical facilities vary from country to country and the Company makes no representations and gives no warranties in relation to the standard of such treatment.
5.2.1 Adequate and valid travel insurance is compulsory for all travelers travelling through Donkeys Adventures. Your travel insurance must cover accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability.
5.2.2 The Company also recommends it covers trip cancellation, curtailment and loss of luggage and personal effects. You must carry proof of insurance with you and produce it if reasonably requested by the company employees or suppliers.
5.2.3 The company reserves the right to cancel or suspend your participation on a trip or in certain activities that comprise part of a trip, at any time, including after the commencement of your trip, with no right of refund, if you are unable to provide proof of insurance when requested. The Company would not be liable for any injury/health conditions/emotional or other conditions suffered by the client during the trip. Similarly, our package cost does not include any personal insurance. Hence, we advise the clients to take adequate insurance packages, including medical emergencies and evacuation by Helicopter.
5.3.1 Please note that mountain adventures are always unpredictable. Bad weather in mountain regions can cause domestic flight delays. In case of delayed domestic flights, Donkeys Adventures will meet departing city accommodation (Guest House) and food (Lunch & Breakfast) costs prior to your trip. However, in case of delayed return flights, the client is responsible to bear all additional expenses including food and accommodation costs. If you wish to make an alternative arrangement such as Helicopter flight to avoid flight delays, all additional cost would be your responsibility.
5.3.2 Any flights forming part of your holiday will be subject to the General Conditions of Carriage and Conditions of Contract of the airline concerned, to which attention will be drawn on the airline ticket. Such flights will also be subject to international law which often limits the airlines liability to passengers in respect of death or bodily injury, delay and loss or damage to baggage. Donkeys Adventures reserves the right to substitute alternative vehicles, carriers and aircraft types if necessary. However, any extra or additional facilities or service cost apart from the itinerary has to be covered by the clients.
5.3.3 Donkeys Adventures does not accept any responsibility for costs incurred as a result of missed international flight, but would assist to make alternative arrangements wherever possible. Please also note that while on the field, we may have to make some changes in the itinerary due to unforeseen circumstances.
5.3.4 It is in the nature of these excursions that arrangements and the participants must remain flexible. The day to day itinerary/agenda and ultimate goal of the excursion are taken as aims and not as contractual obligations. It is the condition of your joining any of our excursions that you accept this flexibility, and you also accept that Donkeys Adventures cannot be held responsible for delays or alterations in the program, or for expenses incurred, due to international or internal flights cancellations, automobiles and other means of conveyance, strikes, sickness, weather and other forces of nature, war, quarantine, force major, political closures and disputes. You will be responsible for any such expenses incurred which, depending on the circumstances.
5.3.5 You acknowledge that traveling with Donkeys Adventures requires a degree of flexibility, and understand that trip route, accommodation and modes of transport are subject to change without prior notice due to local circumstances.
5.3.6 Under no circumstances can Donkeys Adventures, any of our ground operators or representatives be held responsible for any wildlife mentioned in our web site or itineraries, but not actually seen during the holiday.
5.4.1 On an excursion of this nature it is necessary for you to abide by the authority of the leader who represents Donkeys Adventures. The decision of the leader as to the conduct, itinerary and objectives of the tour is final. Booking and trips conducted with Donkeys Adventures signifies your agreement to this. If in the opinion of the leader your behavior or physical condition is detrimental to the safety, welfare and well-being of the group as a whole, or if (in consultation with the trek medical person, if there is one) the leader considers your general well-being will be put at risk by continuing with the holiday, you may be asked to leave the tour without the right to any refund.
5.4.2 Although we will always handle your baggage and personal effects with great care while in our possession (such as when carried by porters, yaks, donkeys and horses), Donkeys Adventures do not, however, accept responsible for any loss, damage or accident to any luggage and property.
5.5.1 You must carry a valid passport and have obtained the appropriate visas when traveling with Donkeys Adventures. Please ensure your passport that for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas for the countries you are traveling. We cannot accept responsibility if you are refused entry to a country or places because you lack the correct visa documentation.
6.1 Any complaints with regard to our tours must be immediately brought to the attention of the tour leader, ground operators or hotelier so that the necessary action to rectify the matter can be taken. However, if by the end of the tour you still feel you have a valid complaint you must notify the company, in writing, within 15 days of the end of your tour with Donkeys Adventures.
6.2 Donkeys Adventures immensely thrives on valuable feedbacks from its clients. Any travel account and tale that the visitors from donkeysnepal.com posted at our site are without edited.
6.3 Donkeys Adventures may quote words partially of fully from your reviews its electronic or printed materials. The quoted text will be cited with its author's name. Further, the authors name will appear alongside of the review at Donkeys Adventures website.
6.4 The review content must not have defamatory language and does not breach any applicable laws.
6.5 Donkeys Adventures reserves the right to publish or not to publish review that is considered to be extreme and possibly prejudicial to any possible legal dispute. Trip review will not be published that give highly personal and possibly libelous opinions regarding a regarding an individual's vacation or holidays affairs.
7.1 Any or all the booking and conformed trips organized through Donkeys Adventures should be bind the above mentioned Terms and condition
7.2 Donkeys Adventures will send copy of Personal Confidential form, Release and Assumption of Risk form and Medical Emergencies, Air Rescue and Treatment Indemnity form once the booking is made. Clients shall fill these form, sign and return to the company on the arrival day and before the trips commence.
8.1 The Company reserves the right to update and amend these terms and conditions at any time. It is the responsibility of the Client to keep updated with any changes. The current version of terms and conditions will always be found on the website www.donkeysnepal.com and will be the terms referred to in any dispute.
9.1 We may need to share your data when we believe it’s required by law or to help protect the rights and safety of you, us or others.
9.2 It is possible that we will need to disclose information about you when required by law, subpoena, or other legal process or if we have a good faith belief that disclosure is reasonably necessary to (1) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (2) enforce our agreements with you, (3) investigate and defend ourselves against any third-party claims or allegations, (4) protect the security or integrity of our Service (such as by sharing with companies facing similar threats); or (5) exercise or protect the rights and safety of Donkeys Adventures, our Members, personnel, or others. We attempt to notify Members about legal demands for their personal data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.
